Who May File with USCIS

You can file Form I-589 for asylum with USCIS if:

  1. You are not a U.S. citizen and are physically present in the U.S.

  2. You have never been issued an A-Number, or you have an A-Number but are not currently in EOIR (Executive Office for Immigration Review) proceedings.

  3. You are in removal proceedings and have been determined to be an "unaccompanied alien child" (UAC).

If you are in EOIR proceedings, you must file Form I-589 with EOIR unless you qualify as a UAC. You can check your EOIR status by calling the EOIR Automated Case Information Hotline (800-898-7180) or by using the EOIR Automated Case Information online system.

Steps for Filing in EOIR Proceedings

If EOIR has your information, including your hearing date, you must file Form I-589 with EOIR. Check the EOIR hotline or website for the correct immigration court address. Filing in the wrong location may result in delays or rejection of your application.

Filing with USCIS

If eligible to apply with USCIS, you can file Form I-589 online or by mail. Use the Filing Instructions Tool for guidance. Note that UACs, individuals whose removal proceedings were dismissed or terminated, and those issued Form I-862 (Notice to Appear) by DHS but not docketed in EOIR, must file by mail.
